Le Conseil des barreaux européens représente environ un million d’avocats européens auprès des institutions européennes. A l’occasion de son 50ème anniversaire, nous avons souhaité retracer les grandes lignes de l’histoire de notre organisation, encore jeune et pourtant déjà riche de réalisations. Pour rendre plus vivant ce travail de mémoire, nos anciens présidents nous ont fait l’amitié de contribuer à cet ouvrage par une brève évocation de leurs expériences personnelles et leurs réflexions. Mais à rien ne sert de regarder le passé si ce n’est pour préparer l’avenir. Les avocats ont un sens aigu de leur rôle en tant qu’acteurs de la justice et garants de l’Etat de droit. Or ce rôle est aujourd’hui souvent perdu de vue, voire minimisé, par les interlocuteurs institutionnels des barreaux. Il nous a donc semblé utile d’inviter les présidents de la Cour de justice et du Tribunal de l’Union européenne à nous livrer leur point de vue sur le rôle des avocats dans l’administration de la justice. Nous avons aussi demandé à deux éminents anciens juges et à un chercheur spécialisé de fournir une analyse critique de la manière dont le législateur européen réglemente les prestataires de services, et notamment les avocats.The Council of Bars and Law Societies of Europe represents around a million European lawyers to the European institutions. On the occasion of its 50th anniversary, we wished to recount the milestones of the history of our organisation, still young and yet already brimming with achievements. To bring this work of memoirs to life, our former presidents have done us the kindness of contributing to this book by recalling their personal experiences and giving us their reflections. But it serves nothing to look at one’s past if one is not also preparing for the future. Lawyers have a keen sense of their role as protagonists of justice and guarantors of the rule of law. Yet this role is today often lost to view, if not played down, by the institutional interlocutors of the Bars and Law Societies. It thus seemed to us helpful to invite the Presidents of the Court of Justice and General Court of the European Union to give us their perspective on the role of lawyers in the administration of justice. We have also asked two prominent former judges and a specialist researcher to provide a critical analysis of the way the European legislator regulates the provision of services, and particularly by lawyers.
